Congress is 535 people, each with their own personal strengths, weaknesses, and agendas. Each one rules their own fiefdom â the Hill office.
Some are profoundly dysfunctional, and others are incredibly effective operations. What makes the difference? New Statecraft with former Hill scheduler and chief of staff @bailleebrown, on how to make "the boss" shine.

Pleased to have been able to contribute to this @YaleJREG symposium on artificial intelligence and the APA.
@adamgcrews argues that courts can adapt to AI by looking to agency practice, rather than through judicial creativity and policy balancing.

DOJ attorney representing Trump admin said there are âmore reasons" to do RIFs in a shutdown, "not fewer," because federal gov't will have to issue back pay to furloughed employees who aren't working: âMorally, this is the right thing to do, and itâs the democratic thing to do."

"By seeking to combine two mismatched categories, the executive order misuses RIFs, misunderstands shutdown plans, and introduces political manipulation into what is meant to be an orderly process for winding down unneeded positions," writes @BridgetDooling.

A couple observations: (1) It's interesting that DOJ only expressly mentions the FTC, NLRB, and CPSC. It will no doubt extend the same position to some others. But the MSPB is one I'm curious about, as there are stronger arguments there that the agency is largely adjudicative.
The Acting Solicitor General has notified Congress of DOJ's intent to ask #SCOTUS to overrule Humphrey's Executorâa major 1935 ruling upholding the independence of agencies like the FCC, FTC, NLRB, etc.

1/ In anticipation of the impoundment brawl-to-be, I highly recommend going back to the Supreme Court's 1997 decision striking down the line-item veto--which was essentially a limited impoundment power that Congress had given to the president.
SCOTUS wasn't having it.
