What happened to Kelsey Fitzsimmons at the hearing to modify release conditions that she have no contact with her child is indefensible. The harm and trauma to her and the baby is incalculable. Why did a superior court judge get to do just that without making mandatory findings?

since people have asked us about a filing on a case of much public interest, I will simply report the facts. We filed a motion to dismiss on September 17. The Court assigned a deadline for the prosecution to respond by end of day Monday, October 27. Initially the court suggested the 24th. Tim Bradl graciously suggested the Monday "to give them the weekend." Late afternoon, Friday October 24, the Commonwealth sought an extension. By filing at that late time, they made it impossible for us to even respond. A few days later, the Court extended the deadline to November 17. We said nothing. No objection. No complaints. It is now after business hours on November 17 and it has been TWO MONTHS since we filed our motion. No response has been filed as far as we know. No response has been emailed to us. No motion seeking additional time has been filed or emailed. No courtesy email has been sent to us, attempting to explain anything. We are simply without a response or even information explaining anything, past the second deadline. That's all the information we have. @DoctorTurtleboy @BradlLawPC
