WHEN LAWYERS ARE DRAGGED, THE CONSTITUTION IS ON TRIAL
The Constitution does not confer fundamental rights as an act of governmental generosity. It guarantees them as limitations upon governmental power.
When Senior Consel informed the Supreme Court that advocates had allegedly been dragged through the streets, detained in buses, and that armed miscreants had attacked citizens while the police stood by, he raised a question far greater than the dignity of the Bar. He raised the question of whether the Rule of Law still governs those entrusted with enforcing it.
A policeman’s uniform is not a licence to violate liberty. Nor can Section 163 BNSS become a charter for executive absolutism.
The right to peaceful protest is not extinguished because its exercise embarrasses the Government. Public order is a constitutional necessity; it cannot become a convenient euphemism for suppressing dissent.
Chief Justice Surya Kant rightly emphasised the right of advocates to participate peacefully at designated locations. But the constitutional duty does not end with recognising a right. A right without an effective remedy is a constitutional promise reduced to a political platitude.
The Supreme Court is not merely the highest court of the land. It is the final sentinel of those liberties which the Executive may find inconvenient and the citizen cannot afford to lose.
When the State demands restraint from citizens, the Constitution demands restraint from the State.
And when those who plead for justice are themselves allegedly subjected to coercion, judicial silence risks becoming the most eloquent encouragement to arbitrary power.

क्या फर्क पड़ता है?
फर्क पड़ता है। लेकिन सवाल यह भी है—किसके लिए फर्क पड़ता है?
राज्य में भ्रष्टाचार है तो लिखिए, खूब लिखिए। मंत्री हो, अफसर हो या उसका कोई करीबी—जांच हो, जवाबदेही हो, दोषी हो तो कार्रवाई हो। इसमें कोई दो राय नहीं।
लेकिन फिर वही पैमाना दिल्ली की सत्ता पर क्यों नहीं?
क्या फर्क पड़ता है अगर राज्य में करोड़ों की बरामदगी खबर बन जाए, लेकिन केंद्र के आसपास उठे गंभीर सवालों पर कलम अचानक संयमित हो जाए?
क्या फर्क पड़ता है अगर विपक्ष से सवाल पूछना पत्रकारिता का धर्म हो, लेकिन सत्ता से सवाल पूछते समय करियर, विज्ञापन और पहुँच याद आने लगे?
यह राज्य सरकार को क्लीन चिट देना नहीं है।
भ्रष्टाचार कहीं भी हो—गलत है। सत्ता कोई भी हो—जवाबदेह है।
बस इतनी-सी विनती है—
संविधान ने केंद्र और राज्य के लिए अलग-अलग नागरिक नहीं बनाए हैं, तो पत्रकारिता ने अलग-अलग पैमाने क्यों बना रखे हैं?
कलम की असली ताकत यह नहीं कि वह किस पर चलती है।
असली ताकत यह है कि सत्ता देखकर उसकी धार बदलती नहीं। 🙏
क्यों लिखें भ्रष्टाचार पर? क्यों किसी की नज़रों में खटके?
क्या फर्क पड़ता है अगर : सचिवालय में मंत्री के ठीक सामने पीएस के चैंबर से घूस का पैसा निकल जाए?
क्या फर्क पड़ता है अगर : मंत्री के पीएस के नौकर चाकर के घर से भी 30–32 करोड़ कैश ही निकल जाए।
क्या फर्क पड़ता है अगर : इंजीनियर से लेकर सचिव और मंत्री तक कमीशनखोरी में लिप्त हों और उनकी खबरें तथ्य के साथ ही आ जाए।
क्या फर्क पड़ता है अगर : नौकरियों के लिए सीटें बिक जाएं, और खरीदार नौकरी में ही रह जाएं। परीक्षाओं के पहले पेपर लीक हो जाए, परीक्षा लेने वाले ही अंदर हेरफेर कर पास को फेल और फेल को पास कर दें।
क्या फर्क पड़ता है अगर : किसी अफसर ने कमाई कर ली, पत्नी, बच्चों के नाम पर महल ही बना लिया ।
क्या फर्क पड़ता है अगर : कोयला, बालू का हजारों करोड़ का अवैध खनन हो, विभाग में घोटाले हों, आप खबरों पर खबरें लिखते रहें।
क्या फर्क पड़ता है, अगर आप ना लिखें?
क्या फर्क पड़ता है, अगर: आपकी कलम सिर्फ सरकारी विज्ञप्तियां लिखें।
क्या फर्क पड़ता है, अगर: आप सत्ता की एजेंडा चलाते, लिखते रहें।
बताइए क्या फर्क पड़ता है, अगर ना ही लिखें?
