Looking forward to part 1 of our wills, trusts and probate case law update this afternoon with @CollinsonFay @Sblbar and Richard Lander (whom we haven’t yet convinced to join Twitter!)
Exciting, but tiring, day in court (from my study) obtaining an urgent interim injunction restraining a party from cremating the body of the deceased, who died from covid 19, in contravention of the deceased’s testamentary wishes.
In Re H [2020] EWHC 1134 (Fam) Cohen J awarded C, who brought a 1975 Act claim, 25% of the CFA uplift as part of her reasonable financial provision. bailii.org/ew/cases/EWHC/Fam…

In Suckling v Suckling Smith J granted an application by a brother to commit his sister for contempt for her failure to comply with an order requiring her to deliver documents and serve accounts in relation to the administration of their father’s estate.
