I once wrote that the #MeToo moment can offer a notion of sexual violence that avoids the pitfalls of radical deconstruction and rigid formalism. Today, in a world governed by platitudes and little care for inquiry, critical thinking or empathy, I still hope this path exists.

I then use this notion to explore the use of algorithms in preventing nonconsensual pornography, suggesting that it is prone to cementing the consent paradigm, blind content moderators to consensual harms, and stifle the debate on the scope and meaning of sexual autonomy.
In the article I generalize on the filter bubble theory to suggest that using machine learning ensnare decisionmakers in "legalistic" filter bubbles when the algorithm employs legal categories to determine what information is brought before them

Also, for those interested in AI-induced legal ossification, I have a forthcoming piece that digs deeper into the issue--will be on SSRN next week, once I make a final publication decision. It's also my job talk paper, if anyone is into hiring...
Thanks for noticing! The draft is still a little rough around the edges but with the help of the amazing editors @ncjolt the final piece should be out in a few months!

Yup! A draft finally on SSRN. I've been thinking about thought experiments involving AI adjudication and how they tend to focus on futuristic AI entities replacing human decision-makers. I argue that this image can overshadow piecemeal AI takeover of law-creation.

Word suggests that I change Holmes's "bad man" theory of law into "Bat Man". I think it may be onto something. What other legal theory concepts can double as comics monikers? I'm thinking Eggshell Skull and Supermajoritarian must be high on that list

Amazing. Can’t help but wonder if anything we’ve achieved as a species tops this
It's #EndangeredSpeciesDay... Mountain Gorillas, who are our cousins, live in Rwanda, the Democratic Republic of the Congo, and Uganda. There are fewer than 1,300 wild Mountain Gorillas left. There are no Mountain Gorillas in captivity. A mother and her baby...
Reading a wonderful student paper about TikTok is making me grow older by the minute. Move over generation gap, it’s platform gap time, and it’s coming for you every five years or so

Wrongdoing that is unrecognized by the legal categories of sexual assault and harassment. I suggest that degradation involves using nonsexual levers to defeat the sexual judgment of another. To say “but it’s not rape/harassment,” I suggest, is a conversation starter, not ender.

This piece has been long in the making and tremendously benefited from much great advice, but I feel particularly indebted to the students in my “Making Criminals” seminar @yale for the inspiring conversations and to the editors @GeorgetownLJ for their amazing work and comments!
