Poland’s constitutional crisis explained using an American political analogy: Republicans represent PiS, and Democrats represent KO and its coalition. In 2015, outgoing Democrats appoint five constitutional court judges. The court rules that three appointments were lawful and two premature. Incoming Republicans replace all five anyway. Their president refuses to swear in the three lawful appointees and swears in their replacements—unlawfully filling seats already occupied. Republicans then impose a quorum the court cannot meet without accepting the disputed judges, a two-thirds voting requirement and procedural delays that obstruct constitutional review. When the court rules those restrictions unconstitutional, the Republican government refuses to publish the judgment in the official gazette, obstructing its legal effect. Further rulings are withheld too. The Republican government effectively decides which judgments against it count. Over time, obstruction gives way to political control. Democrats return to power in 2023, reject the compromised court’s legitimacy and withhold its rulings. In 2026, they elect eight judges to fill accumulated vacancies—not expand the court. The Republican president refuses to swear in five, who take oaths without him. The court’s leadership refuses to seat them. In October, seven judges elected by the Democratic-led majority enter the court with government security officers. So, in a nutshell: The court was first obstructed and captured by Republicans.
