Reminder: Special Counsel Jack Smith’s Javert-like pursuit of President Trump included Smith alleging a conspiracy to impair the federal process of counting and certifying presidential votes through deceit. Does recruiting a candidate to divert votes in a Senate election constitute such a conspiracy? Smith also alleged a conspiracy to impair citizens' rights to vote and have their votes counted. In fact Smith indicted President Trump on four charges: Smith’s original indictment, filed August 1, 2023, lists them explicitly on its first page: 18 U.S.C. § 371 — Conspiracy to defraud the United States. 18 U.S.C. § 1512(k) — Conspiracy to obstruct an official proceeding. 18 U.S.C. §§ 1512(c)(2) —Obstruction of and attempt to obstruct an official proceeding. 18 U.S.C. § 241 — Conspiracy against rights. Smith was a zealot, using reckless and unprecedented theories which the Supreme Court’s ruling on presidential immunity upended, but as DOJ blessed Smith’s legal “theories” at the time of the indictment, should the same theories also be applied to Team Peltola? It is a federal election just like the 2020 presidential election, but Team Peltola has zero immunity.
