On September 15, a unanimous three-judge panel of the Eighth Circuit Court of Appeals reversed the dismissal of his First Amendment lawsuit against the Minnesota Board of Medical Practice — ruling he deserves his day in court. The backstory: from the start of COVID through mid-2022, the Board received 18 complaints about Dr. Jensen. The objection was almost always the same — "spreading misinformation" — for opposing vaccine mandates and school and business closures. Those complaints triggered four investigations. He spent years and a fortune defending his license. All four investigations closed. Zero discipline. Zero patients harmed. As Judge Stras wrote for the unanimous panel: "Years of investigations by the Minnesota Board of Medical Practice caused Dr. Scott Jensen to speak less and spend more. Either would be enough for a court to hear his case, so we reverse." Let that sink in. A state licensing board used years of investigations to punish a doctor for his political speech — and a federal appeals court just said: not so fast. The case now goes back to the district court for a ruling on the merits. But this is a win — for patients, for medical freedom, and for the free speech of every Minnesotan who dares to question the consensus. When doctors are afraid to speak, patients lose.
