NEWS | California New Car Dealers Association’s lawsuit against Scout and Volkswagen proceeds after judge denies second motion to dismiss:
The CNCDA sued in April 2025, alleging Volkswagen illegally competes against dealer partners through its affiliated brand, Scout Motors.
A 2023 law forbids automakers from selling affiliated brands without franchises, yet Scout entered $100 deposit agreements with consumers through its website.
Chief Judge Cynthia Bashant let the unfair competition claim proceed in March, then denied a second dismissal bid last week.
“We believe the court’s decision underscores the strength of our legal arguments and puts us in a strong position as the case moves into its next phase,” said CNCDA President Brian Maas.
Big picture: “There are nearly 650 franchised dealer owners in California, and every one of them has a stake in whether manufacturers can compete against their own business partners,” Maas said.
