PROTECT THE COURTS: Election Petitions Must Be Decided on Evidence, Not Pressure!
The courtroom is the last temple of democracy. When the ballot box is contested, it is the independence of the judge that keeps the Republic from descending into anarchy.
Yesterday, Kampala was reminded of that truth. On 29th October 2026, the Nakawa Chief Magistrate鈥檚 Court delivered a consequential judgment. In a ruling delivered via the Electronic Court Case Management System, Chief Magistrate Adoko Joe Fay nullified the election of National Unity Platform鈥檚 Godfrey Luyombya as directly elected councillor for Nakawa Division II and ordered the Electoral Commission to gazette NRM鈥檚 Kitosi Emmanuel as the winner, after finding electoral non-compliance that substantially affected the results.
Background of the Petition
The petitioner alleged that Hon. Godfrey Luyombya鈥檚 nomination was defective because the Electoral Commission nominated him as Luyombya Godfrey, whereas his nomination forms reportedly bore the name Muyombya Godfrey. This discrepancy raises serious questions that deserve careful examination based on the evidence presented before the court.
If the Electoral Commission accepted the nomination, placed Luyombya Godfrey鈥檚 name on the ballot paper, and voters subsequently voted for him in the election and rerun, should voters bear the consequences of a discrepancy allegedly originating from the nomination process? These are important questions that must be addressed within the law and the evidence before the court.
But where is the accountability of the Electoral Commission?
Why have Mr. Simon Byabakama and the Electoral Commission continue keeping silent when these forgeries and fraud are being cooked in their archives . What steps were taken to verify the authenticity of the nomination forms, and who should be held accountable if any irregularities are established? Ugandans deserve transparency, answers, and accountability from the institution entrusted with safeguarding the integrity of their elections.
Whether you are NUP, NRM, or independent, you may agree or disagree with the judgment. That is the nature of litigation. One side wins, one side loses. But what we must never accept is any attempt to undermine the judicial process itself.
There have been worrying allegations of intimidation surrounding election petition proceedings in Nakawa and Makindye, including claims of veiled threats, political mobilisation around courts, and social media pressure directed at judicial officers. Such allegations must be taken seriously and independently investigated. No judge or magistrate should be threatened or pressured for performing their constitutional duties.
To intimidate a judicial officer handling an election petition is not merely an attack on one magistrate. It is an attack on every voter who stood in the sun in January and February 2026. It undermines public confidence in the justice system and sends a dangerous message that political influence could matter more than evidence and the law.
The case involving Godfrey Luyombya demonstrates why election disputes require calm, evidence-based adjudication. His electoral journey has involved a disputed January poll, a rerun in Naguru I and II in March, where he reportedly polled 5,066 votes against Kitosi Emmanuel鈥檚 2,729, and the subsequent court decision in October. A matter involving affidavits, declaration forms, nomination documents, and numerical analysis requires a judicial officer to examine the evidence and apply the law without fear or favour.
Any allegations of attempts by political actors, including Mayor Uhuru or Mr. Omar Yasin, to influence or intimidate judicial officers should be investigated through the appropriate legal channels. No individual, regardless of political position or affiliation, should be above the law.
Our position must remain clear:
Protect the independence of the Judiciary.
PROTECT THE COURTS. PROTECT THE VOTE. PROTECT DEMOCRACY!
