Just six days before this injunction, the Department of Justice announced a lawsuit alleging that more than 20,000 likely noncitizens appeared on California’s voter rolls. And that brings me to something I’ve been asking for years… HOW IS THE GOVERNMENT SUPPOSED TO DETERMINE WHETHER ITS DATABASES ARE ACCURATE IF INVESTIGATORS ARE RESTRICTED FROM FOLLOWING UP ON THE VERY DISCREPANCIES THEY DISCOVER? An investigative lead isn’t a conviction. A database discrepancy isn’t automatically fraud. But a discrepancy isn’t automatically meaningless, either. The Government has a responsibility to investigate credible evidence of Election-Law violations, while protecting the rights of eligible American voters. The Judge’s stated concern is that unreliable citizenship data and certain investigative tactics could intimidate lawful voters. The Administration maintains that its efforts are intended to identify unlawful registrations and enforce federal election laws. NOW HERE’S MY THEORY… I find the timing deeply suspicious. We’re approaching Election Day. Federal investigators are examining suspected unlawful voter registrations. The Department of Justice is bringing cases. And suddenly, a Federal injunction threatens to restrict certain investigative methods immediately before early voting begins in New York. Is this about protecting eligible voters, or are legitimate election-integrity investigations being unnecessarily obstructed? Judicial decisions aren’t immune from scrutiny, especially when they affect Federal Enforcement efforts so close to an Election. And let’s be clear: this injunction does NOT prohibit every voter-fraud investigation, every voter-roll cleanup effort, or voting-machine audits. Its restrictions concern specific DHS investigative activities. Nevertheless, the practical consequences deserve examination. THE AMERICAN PEOPLE DESERVE TO KNOW: * How many suspected unlawful registrations has DHS identified? * How many have been independently verified? * How many database discrepancies involve naturalized American citizens? * What investigative methods remain available under the injunction? * Why was this particular enforcement deadline selected immediately before early voting? * Will the Ninth Circuit intervene before Friday’s deadline? And while we’re examining Election Integrity, let’s not ignore voting-machine certification, security testing, ballot reconciliation and chain-of-custody procedures. Those issues require their own evidence and legal scrutiny. ELECTION INTEGRITY SHOULD NOT BE A PARTISAN ISSUE. Every eligible American deserves a protected vote. Every credible allegation of unlawful voting deserves a lawful investigation. And every judge exercising authority over federal election enforcement should be subject to the same transparency and accountability expected of the Executive Branch.
