ALT Woman representing a creative muse, holds a laurel wreath in victory. She is surrounded by eagles who celebrate her accomplishments and stands on a pedestal overlooking the horizon. The colors are warm and comforting. This painting is a love letter to the art community and the accomplishments of research team creating technology for the benefit of mankind.

ALT In the end, I find the conclusions are a little hollow. You agree that Image Generators will exist even if the lawsuit ends with a verdict of "copyright infringement" on the dataset level. They won't go anywhere. So the best outcome I can see is one where it is deemed infringing. Using some imagination: if Stability did copyright infringement ✅ Artists can still get jobs and compete on the market since their work can't be used without permission. They retain some competitive edge. ✅ Artists have a way of supercharging their personal workflows with AI assistance. ✅Datasets have to be ethical, leading to some opportunities for revenue streams for artists. Many WILL sell license to train their work! ✅ "Style" and an artists "voice" retains some value. ✅ People can still generate cool images that they feel matches what they want to see. ✅People have SLIGHTLY more protection against rampant harvesting of data for use by corporations. ALT Shutterstock's email: News for artist recognition in advanced technology worldwide, and news for Shutterstock contributors! You will now accrue royalties when your IP is used in the training of AI-generative models or used for licensing of generative assets created using Shutterstock’s software. Contributing artists can view their earnings in their account in the Earnings Summary 'By month' tab as 'Contributor fund.' Why we are doing this: Generative content would not be possible without contributing artists, and Shutterstock believes contributors should be rewarded. To recognize our artists’ contributions, we will be paying royalties for the role artists’ IP plays in the development of generative AI models trained on Shutterstock’s library as well as for ongoing licensing activity of AI-generated content by Shutterstock’s content generation tool.

ALT My response email: Hello, I am INCREDIBLY alarmed by this email, and I have immediately turned off the licensing on my artwork. Am I to understand that my work has ALREADY been used in an AI dataset, and I will only be able to opt out of FUTURE datasets? Am I reading that correctly? I need absolute assurance that my work has NOT yet been used in any AI dataset, and if it has, I need to know that it will be pulled from that dataset immediately. After that, I would like to know how I can completely remove all of my images from Shutterstock and Offset and cancel any standing agreement we have before deleting my account entirely. Thank you, Michele

ALT Shutterstock's response email: Dear Michele, Thanks for reaching out to Shutterstock Contributor Care. We sincerely appreciate your business trajectory of over two years with us and with great pleasure would be attending to all of your inquiries and request. Today, I'll be more than happy to assist you by providing more information about this matter; I realize the importance for you to have this clarified. The Shutterstock Contributor Terms of Service (Paragraf 1. Article a) state: By submitting any Content to Shutterstock, you grant to Shutterstock a worldwide, sublicensable, non-exclusive right and license to index, analyze, categorize, archive reproduce, prepare derivative works incorporating, publicly display, sell, advertise, and market, any Content uploaded by you and accepted by Shutterstock for any reasonable business purpose, including but not limited to the distribution of your Content to Shutterstock customers, to optimize the performance and operation of Shuttesto

ALT My response: FUCK YOU. This response has made me fucking FURIOUS. When I signed this contract back in 2015 AI TECHNOLOGY DID NOT FUCKING EXIST. I agreed to this contract with the full understanding that people could use and edit my work. But I had NO POSSIBLE WAY of knowing or consenting to using my artwork's raw data to train an algorithm, because that technology DID NOT YET EXIST. If AI had existed at the time, I NEVER would have signed your fucking contract, and I don't remember receiving ANY fucking warning that the terms of my 8 year old contract would now suddenly include a band new usage that I abhor. Hide behind your legal language all you want. I am not interested in whatever pennies I may be earning now that you've ripped apart my artwork and sold it for scraps of data. And I'll make sure to inform other artists that your company cannot be trusted with our artwork, and to immediately remove anything they have on Shutterstock.
