Day 10 of the Sheng Thao trial. Former City Administrator Jestin Johnson took the stand and described how Sheng Thao personally directed him toward the Duongs’ modular housing company. She introduced him to Evolutionary Homes and encouraged him to tour the showroom in January 2024. After the visit he texted her that it was “quite informative,” even as he flagged the cost and wrote, “We don’t have the money for this.” He photographed the units and sent the images to the city’s housing director. Johnson also testified that Thao and her chief of staff asked him to meet with David Duong and Mario Juarez about their businesses. The conversations happened while the alleged deal for Oakland to buy the container homes was still being discussed inside Evolutionary Homes. Former Assistant City Administrator LaTonda Simmons testified about Oakland’s emergency shelter ordinance, renewed in September 2023. The ordinance let the city administrator expedite certain homelessness projects and award contracts without the usual competitive bidding process. Prosecutors have pointed to that expanded authority as part of the pathway the Duongs expected Thao to open for their company. The jury heard that the mayor who received campaign support and whose partner was paid by the Duongs was the same person steering her top administrator toward their housing venture. Johnson returns Friday. – at Oakland, CA

Day 9 of the Sheng Thao trial. Prosecutors played secret recordings from Evolutionary Homes board meetings for the first time. Cecilia Mendez, who took the recordings without the others’ knowledge, testified under a court order after receiving immunity. The tapes captured David Duong and Mario Juarez in late 2023 discussing what they said was their deal with Sheng Thao. On one recording Duong said, “that’s not the deal I made with Sheng – a deal is a deal.” He added, “I will go to jail for this.” When Juarez told him Andre Jones was asking for another $20,000 after already receiving $85,000, Duong replied, “I can’t believe it. They’ve not done anything … and then they’re asking for more money?” Juarez called it “an insult.” On another tape Juarez criticized Thao for wanting Evolutionary Homes to land an Alameda County contract first. “That, first of all, is not the deal we made with Sheng,” he said. He went on: “For me, it’s a personal issue with her now. I have a long memory and I’m pretty vengeful. And with her, it will not be a difference.” He added that there are “consequences to not keeping your end of the bargain” and that her failure to deliver would be “a problem for her re-election.” The recordings show the men who financed her campaign and paid her partner talking among themselves about an agreement they expected her to keep. Prosecutors called the tapes core evidence of the alleged scheme. – at Oakland, CA

Aisha Wahab told America to have a relationship with the Taliban. Today her own neighbors showed up at Hayward City Hall holding giant banners that said she is advocating for terrorists. Afghanistani, Iranian, Sikh, East Indian, and Hispanic leaders stood together and rejected her. They said her comments on Democracy Now minimize the trauma of people who fled that regime. They said the Taliban is a terrorist group. They said a member of Congress should not be asking the United States to sit down with the men who banned girls from school and killed American troops. Wahab went on national television and said America should keep “having a relationship” with whoever is running Kabul. Whoever is running Kabul is the Taliban. She has not taken it back. – at Hayward, CA

Oakland’s 911 system went down last week. Dispatchers watched the computer system freeze. Phone lines went dead. Internet died. For more than 24 hours, every 911 call in the city had to be routed to the Alameda County Sheriff while Oakland police only answered the absolute highest priority calls. Fire still handled medical calls. Everything else waited. Police said copper and fiber lines were cut. The chief called it a perfect example of theft that could cost people their lives. Backup systems failed. The city and AT&T spent the night repairing cut cables before full service returned days later. This is the same city that spent years with some of the worst 911 answer times in California. The state standard is 90 percent of calls answered in 15 seconds. Oakland was at 37 percent in 2023. It climbed to 80 percent in August. Still short of the standard. Still short of full dispatcher staffing. Then the whole system collapsed because someone cut a wire. Barbara Lee stood at a press conference and said 911 was ready. Residents who called during the outage know that was not true. A city that cannot keep its own emergency lines working is not a city that is safe. It is a city that is one cut cable away from silence when people need help. This is who has been failing Oakland. – at Oakland, CA

Ro Khanna is using a dead child to attack American energy. He posted a video from Pennsylvania saying he sat with a family that buried their son after a rare cancer, that other young people in the town got rare cancers too, that they grew up near fracking wells, and that gas companies are still drilling next door. His demand: stop fracking in residential communities. No study. No data. No control group. Just a grieving family, a camera, and a Silicon Valley congressman who already decided the villain before he arrived. This is the same man whose household assets were reported between $69 million and $167 million, who logged more than 5,400 trades and up to $165 million in volume last year, and whose children hold stakes in private golf courses. He draws eight-figure passive income while he flies into energy communities, films their pain, and tells them the industry that pays their bills and heats their homes is the reason their children die. Pennsylvania has produced natural gas for years. Cancer rates vary by genetics, lifestyle, industrial history, and chance. Khanna offers none of that. He offers a clip that turns a family’s tragedy into a campaign ad for the New Deal branding he is selling in steel towns and on national television. Fuck Ro Khanna. – at Pennsylvania, USA

Day 8 of the Sheng Thao trial. Prosecutors hit a snag with their next witness. They planned to call Cecilia Mendez, Mario Juarez’s former girlfriend and the mother of one of his children, who recorded Evolutionary Homes board meetings. David Duong’s attorney asked whether she had been warned that recording people without consent could be a crime. Judge Yvonne Gonzalez Rogers asked if Mendez had a lawyer. Prosecutors said she did not. The judge ruled she would not testify without one and said she would try to find her counsel. Later the judge signed an immunity order so Mendez’s compelled testimony could not be used against her. Prosecutors still intend to play ten excerpts of her recordings once she takes the stand. While that was sorted, defense lawyers spent the day attacking how the FBI handled Mario Juarez. David Duong’s attorney told Agent Katherine Barclay, “For Mr. Juarez, you made a different decision. You chose to treat him differently.” The FBI seized devices from Thao, Jones, and the Duongs but never took Juarez’s phones, computers, or iPad, relying instead on his iCloud and email. Barclay said agents already had substantial data from those accounts. Andre Jones’s lawyer presented company materials listing Jones as a government relations representative, messages from Juarez about modular homes shipped from Mexico, and photos of Jones with Juarez and the Duongs after a September 2023 San Jose meeting. He argued these showed real work, not a no-show job, and noted that Oakland never bought the housing units and never appointed Larry Gallegos. An FBI analyst also testified that agents found jewelry belonging to Juarez—a silver watch and gold braided bracelet—inside a bank deposit envelope in a closed cabinet in Andy Duong’s garage. She said it felt hidden. The items were tied to a May 3, 2024 confrontation outside California Waste Solutions where Juarez was injured after being locked out and later reported corruption allegations to police. Barclay remains on the stand. Mendez is expected next, followed by former city administrators Latonda Simmons and Jestin Johnson, then Mario Juarez himself. – at Oakland, CA

Day 7 of the Sheng Thao trial. Prosecutors played a 2019 call Andy Duong secretly recorded. Fresh out of a closed-session City Council meeting, then-Councilmember Sheng Thao called him to strategize about a lawsuit against California Waste Solutions. She told him she preferred a private room for the next day’s meeting. “I prefer a private room because we don’t really want to be seen with you guys,” she said. A 2023 call was played too. Thao vented to Duong about Councilmembers Treva Reid and Janani Ramachandran. “Fuck Treva, dude, I’m so sick of Treva,” she said. “You’re going to have to fucking pick and choose, because I’m not fucking with those bitches. They don’t do any favors for me at all.” She told him not to invite Reid to anything that “even sounds cool.” Thao’s pricey lawyer spent the day cross-examining FBI Agent Katherine Barclay. He stressed that Thao ignored a string of texts from Mario Juarez in the weeks before the 2022 election, that the “Deal Points” note was never sent to her, and that no recording shows her asking Duong for money. He also highlighted texts where she demanded Andre Jones pay the rent and argued the couple’s money problems were ordinary disputes, not benefits from the scheme. No cash was found in the 2024 search of her home. Judge Gonzalez Rogers noted that some jurors looked disengaged and warned the lawyers their eyes were glazing over. Cecilia Mendez, who recorded Evolutionary Homes board meetings, is expected next. Mario Juarez is still set to testify this week. – at Oakland, CA

.@IlhanMN endorses @AishaBbWahab for Congress. Here is them partying at eStCru, the California winery owned by Ilhan Omar’s husband. That winery shut down in April after investors were sold empty barrels and told they contained wine that would age. Omar’s financial disclosures showed her husband’s stake jumping from as little as $15,000 to as much as $5 million in one year, then suddenly listed as worthless. House Oversight is investigating. The business is gone. Wahab still walked in and posed with Omar at a winery that sold empty barrels and is now under federal investigation for fraud. This is who she stands with. This is the company she keeps. Vote them both out by November 3. – at Napa, CA

Jackie Fielder wants San Francisco City Hall to open a bank so it can make risky loans to NGOs. Proposition B is her project. She co-founded the SF Public Bank Coalition in 2017. She co-sponsored the measure. DSA SF calls her their “socialist in office” and is running the Yes on B campaign. The Controller’s office says this thing could cost up to $460 million in 8 years alone. The measure itself provides 0 funding. Political appointees would pick the loans. When these loans fail, taxpayers will cover the loss. Mayor Daniel Lurie is against it. This is what she is selling while her district cannot keep a used needle out of a first grader’s hand at Marshall Elementary. While 16th and Mission stays an open drug market. While the Mission leads the city in street-garbage reports. She was gone 105 days on paid leave, the longest leave of any supervisor in San Francisco history. She came back and shilled this grift. Vote NO on Prop B by November 3. – at San Francisco, CA
