IMO they did what a lot of people do...unintentionally included biased tropes in their artistic expression. It was risky to choose 'apes' as the avatar in the first place given the simianization issue...where was the DEI consultant on this project!!
As to how the original artist @allseeingseneca viewed the work, she claims provenance for the 'bored expression' features but has disavowed the traits (in a text chain with @ryder_ripps) and attributes those most of the other traits to other artists. yahoo.com/entertainment/nft-…
After following since January, doubt Ripps thinks the BAYC founders are on the far left of this spectrum. Seems like the complaint is that the BAYC collection is blue and not yellow or green. The 4chan thing seems speculative.
The copyright is established on creation of the work. below from the USPTO site...however, you can't file suit for infringement until you register. And I agree with you...the individual ape copyright thing is a tough issue because of only minor derivative differences.
Agree but I think Ripps is calling them out for not disavowing the problematic (ADL's words) part of the imagery.
