This is essentially what happened in court Wednesday; the judge took into account the impact of the financial costs of a 'guilty' verdict to TfL. That's mitigation.
Mitigation is only submitted after a guilty verdict and before sentencing.
The judge acted as the defence for TfL.

He knew it would make no difference to air quality
He knew it would plunge families into poverty and harm children's health
