This is the heartbreak that is so often ignored. When boys play girls’ sports, the boys get institutional support and sympathetic media profiles, while adults in charge congratulate themselves on their virtuous ability to ignore reality. But girls are left abandoned on the sidelines, grappling with a devastating but unmistakable message: “You don’t matter.” States like Washington will toss girls’ fairness, safety, and opportunity aside the moment it interferes with the interests of a boy who claims to be a girl. This isn’t just wrong. It’s a deliberate decision to treat girls worse than boys and demand sacrifices from them that boys don’t have to make. This is unlawful sex discrimination under Title IX. That’s the argument we made in a recent application to the Supreme Court. On behalf of our client Kallie Keeler, we asked the Court to stop this unlawful discrimination and make Washington state give her a fair and safe playing field so she can play the sport she loves. This scene just shows several more human reasons why the Court’s action is needed.
