"Ironically, the proposal could increase corruption by making it more difficult for citizens to organize against powerful politicians and the interests already entrenched in Lansing," @HeatherLauer said. michigancapitolconfidential.…

My first brush with anonymity was in childhood, in a Catholic confessional. As I write in @BostonGlobe, I think we forget how important anonymity is in our daily lives. It's so routine that we don't even notice we use it. But we'll miss it when it's gone. And that day is coming.

New Mexico is becoming one of the most hostile states for free speech in America. The "misinformation" case against Meta, the regulation of political satire Babylon Bee is suing over, the donor disclosure rules Rio Grande Foundation is challenging. There's a lot.

The "KYC everyone for everything" situation has gotten totally ridiculous. Even for non-financial products & use cases, I am having to scan my face and drivers license to get access to things like a Lime scooter, e.g. Before they could give me accounting advice, a Big 4 firm recently asked me to send a photo of my email *attached as a JPEG*. This expectation creep around personal data sharing already has documented devastating consequences (e.g. financial ruin) at the individual level. It's only going to be a matter of time before personal identity compromise of enough individuals leads to a total collapse of online trust.

My colleague @sarahemclaugh on the growing threat to our right to speak anonymously online, both here in the United States and abroad: "Americans are mobilizing against that sick feeling you get from suspecting you are always watched." bostonglobe.com/2026/10/20/m…

Myth: Prop 2 is about stopping utility companies from corrupting Lansing. Reality: Prop 2 is about empowering elected officials to target and chill policy advocacy under the guise of regulating campaign finance.

Anonymity is one of the best guards we have against consequences ranging from social embarrassment to overt government oppression. So why are we giving it up without a fight? My latest at @BostonGlobe on free speech, anonymity, and the changing internet: bostonglobe.com/2026/10/20/m…

In about two hours, I’ll be chatting with my colleagues Matt Nese and Alex Baiocco about their excellent analysis of the 2026 state legislative session for nonprofits and donors. Join us! events.zoom.us/ev/AtHaHh7JAQ…

So many efforts to "get money out of politics" really just target *some* kinds of money in politics, while leaving other avenues of paying for political influence wide open. It devolves into picking winners and losers.

I-194 won’t get money out of Montana politics. Wealthy donors and super PACs can still spend unlimited sums, while everyday Montanans lose the ability to pool their resources and speak out. This is a gift to the political elite. My op-ed in @bozchron. bozemandailychronicle.com/op…

This column argues that citizens should not be allowed to try to influence public policy without exposing their home address so every lunatic on the planet can stalk and harass them. Maybe that works for the comfortable and the complacent, but ordinary people need privacy.

Something that gets lost in these debates sometimes is that SCOTUS upheld campaign finance disclosure only after severely curtailing what kinds of speech can be placed in that regulatory bucket.
"If passed, Proposal 2 would require all issue advocacy ads to disclose donors, regardless of if it tells voters who or what to back. The proposal also changes the language in state law from ‘radio or television’ to ‘audio or video’..." freep.com/story/news/politic…

In Michigan, Arizona, and elsewhere, we see groups seizing on campaign finance disclosure precedents to try to limit mere "influence" in policy debates, which is exactly what SCOTUS would not allow in Buckley. unitedforprivacy.com/donor-d…

"The ballot summary says I-194 doesn't apply to news, commentary, or editorial content. However, the actual law exempts only 'bona fide' commentary, a term it never defines." What could go wrong? billingsgazette.com/opinion/…

Arizona's anti-"dark money" law may still ultimately be ruled unconstitutional, but it's survived long enough to drastically change the landscape of speech and association in Arizona.

The Trump "PSAs" offer a good occasion to remember that incumbents have many opportunities for self-promotion that don’t show up as campaign spending. This must not be forgotten when debating limits on "money in politics."
