We have an important update in Del Toro v. Polis. Yesterday, Judge Martínez denied our request for a preliminary injunction challenging Colorado’s permit-to-purchase law, SB25-003. The ruling is disappointing, but it is not the end of this fight. We strongly disagree with the judge’s reasoning and believe he applied the law incorrectly while overlooking important evidence about the burdens this law places on Coloradans seeking to exercise their Second Amendment rights Beyond the legal errors, the ruling overlooks the real costs and burdens imposed on applicants. For example, the judge largely disregarded the mandatory training, which can cost $200 to $400, along with additional processing fees charged by some county sheriffs. Colorado cannot make the exercise of a Constitutional right unnecessarily expensive, complicated, or burdensome simply because government officials believe they should. MSLF and our partners in this case are evaluating next steps on how best to strike down this unconstitutional law.

Landowners should not have to guess whether their property is subject to federal regulation. The Environmental Protection Agency (EPA) and the U.S. Army Corps of Engineers proposed updated rules defining which waters qualify as “waters of the United States,” commonly known as WOTUS, under the Clean Water Act. The agencies’ supplemental proposal follows the Supreme Court’s 2023 decision in Sackett v. EPA, which narrowed the scope of federal authority over wetlands and clarified the standards for determining which waters fall under the Act. MSLF filed comments urging the agencies to translate that decision into clear, objective, and workable regulations. The goal is straightforward: federal agencies should apply the law consistently, use reliable evidence when determining whether a water is federally regulated, and provide landowners with a meaningful explanation of why their property falls within federal jurisdiction. Mountain States Legal Foundation has filed a new amicus brief with the U.S. Supreme Court in a case challenging the Environmental Protection Agency’s authority to revise national air-quality standards. MSLF is asking the Court to review whether the EPA can revise these standards earlier or more frequently without following the “thorough review” process required by federal law. The outcome could have significant implications for Western states, where federal air-quality standards affect energy, mining, agriculture, infrastructure, forest management, and other natural-resource activities. Mountain States Legal Foundation has filed a new amicus brief with the U.S. Supreme Court in Alaska Policy Forum v. Alaska Public Offices Commission. The case raises important First Amendment questions about whether nonprofits can be forced to register as campaign groups, report their expenditures, and publicly name their largest donors simply because they speak about an issue that later appears on a ballot. MSLF is urging the Supreme Court to protect the right of organizations and their supporters to engage in public debate without unnecessary government intrusion into their private associations. Yesterday, the Ninth Circuit Court of Appeals in Diemert v. City of Seattle granted a partial victory to Joshua Diemert. Joshua Diemert worked for the City of Seattle when the city rolled out its sweeping “Race and Social Justice Initiative” (RSJI). In yesterday’s ruling, the Ninth Circuit Court of Appeals concluded that the workplace incidents Joshua Diemert experienced were “sufficiently numerous, frequent, and severe to create a triable issue as to the existence of a racially hostile work environment.” The court expressly recognized that race-conscious workplace training programs may violate Title VII when they create a racially hostile work environment. At 14 years old, Israel “DT” Del Toro lost his father. Before he died, his father asked DT to make a promise: “Take care of your brothers and sisters.” DT has spent his life keeping that promise. He carried it into the U.S. Air Force, where he served as a special operations paratrooper and put his life on the line for his fellow service members. Then, in Afghanistan, a roadside IED changed everything. DT suffered burns over 80 percent of his body, spent three months in a coma, and nearly died three times.Doctors didn't expect him to walk again. DT proved them wrong. He became the first 100% disabled veteran to reenlist in the Air Force, and his commitment to protecting others never stopped. A Patriot’s Promise is the story behind the man, the soldier, and the fight. It is a powerful story of courage, sacrifice, resilience, and one promise that shaped an extraordinary life. Meet the man behind the case. Read his story. give.mslegal.org/donate/patr…
