Mountain States Legal Foundation is fighting "death by paper" — federal permitting delays that quietly kill small Western mining, energy, and farm operations without a formal denial.

Oral arguments are over. Colorado threw everything at the wall to see what would stick as well as make things as confusing as possible (a strategy the anti-gun side often deploys). Mike McCoy with @MSLF did a great job representing gun owners.
The judge apparently didn't engage a whole lot, but did indicate that he would be taking his time with the ruling, so we don't look for anything speedy there.
Next Monday, @RMGOColorado's lawsuit against the CO 3-day waiting period will have oral arguments. The district court judge just published a detailed agenda that reads like a desperate request for CO's attorneys to find him some grounds to uphold this law.

Bruen step one - check. And now in light of Wolford, this should be the end of that discussion. (Also shoutout to @MSLF's waiting period win at the 10th Circuit!)

This is true. @MSLF has done incredible and mostly unheralded work on the air traffic controller case over the years, and they deserve major credit for their diligence and commitment to it.
Replying to @tracewoodgrains @SecretaryPete
Worth giving credit also to @MSLF for litigating this, and **especially** to Zhonette Brown (now general counsel @NCLAlegal) who was primarily responsible for Brigida's success (and its existence, I think?).

BREAKING: President Trump just signed a Presidential Memorandum ordering an investigation into aviation safety and to dismantle DEI policies put in place under Biden.
Mountain States Legal Foundation retweeted
For whatever reason, the Federal Aviation Administration (FAA) had DEI programs.
Those programs were just ordered to be terminated.
"The FAA oversees safety for more than 45,000 flights and 2.9 million airline passengers."
Seems like something where hiring should be purely merit based.

If @PeteButtigieg is serious about helping his party win, he'd better find a stronger answer on DEI. Right now, Biden's DoJ is suing his city of South Bend alleging unfair hiring practices because its police officer test—like all fair academic tests—has disparate impact.
Right now, he is facing a class action suit from prospective air traffic controllers disqualified by an absurd and unfair "biographical questionnaire" created in the name of DEI, one where interest groups gave answers out and where "correct" answers included claiming to have gotten low grades in science. He has done nothing about it.
Look, I respect Buttigieg. I think he's perhaps the best and the boldest orator the Democratic Party has, and respect that he did what Kamala Harris never managed and spoke candidly to undecided voters. And I know the job of a campaign surrogate is to fluff up the boss, not to speak with candor about the things that matter most.
He was speaking to a low-information voter, and "I don't think our lives would be better off if we had more uniformity, inequity, and exclusion" might be persuasive enough to someone like that. But anyone—anyone—who has seen the specifics of the battles on the ground knows how unpersuasive that answer should be.
People are not hypothesizing about abstract unfairness. They can see specific, ludicrous examples of unfairness that any close observer should object to. Buttigieg has a choice: did he preside over racist hiring practices by using a standard, easy test for police officers, as his administration is now suing his city over? Was the FAA's absurd biographical questionnaire so fair that his administration is correct to fight the class action suit?
Or are both of those actions clear examples of government overreach in the name of "DEI," examples that a courageous and effective politician would do something about instead of mouthing platitudes?
I don't know who's going to win this election, but I do know that Buttigieg is ambitious, this is not the last election, and this issue is not going away. Harris wholly failed to answer this question on the campaign trail. Now Buttigieg has four years to come up with something better.

NEW: Unlocking the ABCs: The Power of Agencies, Ballots, and Colleges in Today's World
We sit down with Will Trachman, General Counsel at @MSLF, to reminisce about his time working in a presidential administration.
Will also talks about Mountain State Legal Foundation's case pending at SCOTUS which concerns what citizen petitions are required to include before an issue is included on the ballot during an election.
Plus, we talk dumb judicial opinions, DEI dismantling, and whether American public education is salvageable.
