The Energy and Petroleum Regulatory Authority (EPRA) has been ordered to pay Sh73 million in compensation to two cooking gas companies whose premises were shut down following the deadly 2024 gas explosion in Nairobi.
The tribunal's decision raises questions about how the regulator exercised its enforcement powers in the aftermath of the tragedy, which claimed several lives and prompted a crackdown on LPG businesses.
The ruling also places EPRA under scrutiny over the financial consequences of its regulatory actions, particularly where businesses challenge the legality of closure orders issued in response to public safety concerns.
