#PBMReform approved through the Trump administration is a drop in the bucket. #PBMs come up with new ways to keep raking in huge profits while patients and independent pharmacies suffer with higher prices and low reimbursements. | @Forbes ow.ly/vB5q50ZLWRP

The terms of the settlement raised several concerns, most notably that it would require pharmacies to hand over all of their confidential purchasing data to Caremark, a direct competitor. In addition, it failed to specify a dispensing fee to be paid to participating pharmacies. APRx has laid out these and other concerns to the FTC in its September 3 submission which you can read here. ow.ly/ei4Q50ZJlHg Read the terms of the settlement here. ow.ly/S5mc50ZJlHe

PBMs don't want transparency, which is why they're trying to crush state attempts to impose fiduciary obligations by claiming that ERISA preempts state regulation. But that claim doesn't survive scrutiny. They're asserting limited fiduciary authority to escape regulation while , networks, and rebate deals that affect payments and drug choices for plans and patients. In other words, they are exercising the kind of discretion that entails fiduciary duty.

The PBM industry says it saves taxpayers money. Fine. Prove it. Open the books. Show every rebate, fee & spread. Let pharmacies compete & patients choose. If your business model really delivers lower prices, transparency shouldnโ€™t threaten it. Sen. @vingopal & my response: newjerseyglobe.com/legislatuโ€ฆ

๐ŸฅณCongratulations to Florida for being the 25th state to file a lawsuit against PBMs over the past 5 years. Prime Therapeutics and Express Scripts allegedly entered into an "illegal horizontal price-fixing agreement" in 2019, which underpaid local pharmacies and hurt Floridians' access to affordable medications.

Tell me where Claude and I got this wrong The U.S. doesn't have a drug problemโ€”it has a $360B+ middleman rebate problem. List prices are inflated just to fund PBM spreads, fees, and retrospective rebates. A blueprint to fix it: An Open Federal Formulary + Transparent Cost-Plus Pricing ๐Ÿงต๐Ÿ‘‡

We're encouraged @TruthRX that PA DHS intends to enforce the new #Medicaid Any Willing Provider law. @PADHSArkoosh there are 13K patients in western PA who need access to Martella's Pharmacy restored ASAP. @ExpressScripts is ignoring them. Will you please help? @WJACTV

#txlege I have witnessed the closures of 2 independent #pharmacies close in the last 30 days. One being one in our group. It will close its doors 8/28. The other that closed was the 3rd oldest pharmacy in TX. Egregious #pbm contracts and low payments are the cause.

The FTCโ€™s settlement with CVS Caremark over antitrust practices reads like a checklist of whatโ€™s wrong with the PBM business model:

Thank you @RepMcCormick and to the rest of @HouseOversight who are working to rein in flagrant PBM abuse! @RepAuchincloss @JamesComer youโ€™re giving an entire sector hope and strength to keep fighting this fight ๐Ÿ™ @TruthRX
Family-owned pharmacies shouldn't be driven out of business by middlemen. The Pharmacists Fight Back Act is one step closer to becoming law after passing out of the House Oversight Committee. We're fighting to rein in PBM abuses and ensure independent pharmacists can compete on a level playing field.

Iโ€™ll go on record here to say 2 things: 1) US healthcare needs laws like HR 6610 b/c the PBMs and their corporate parents wonโ€™t stop until the system is bled dry, and 2) @TruthRX stands with and ready to help our fellow providers fight this fight
This bill will lower drug prices and pay independent pharmacies well, and it doesn't set prices. Here is how it works: 1. It uses NADAC to determine the prices of drugs. This is a market-determined price. 2. It ensures that 100% of the manufacurer rebate goes to the patient at the point of sale and NOT to the PBM. This will LOWER the costs of the drug at the counter for the patient. 4. It prevents steering of the patient to a higher-cost PBM-owned pharmacy This bill lowers prices, provides competition, reimburses independent pharmacies fairly and stops the middleman known as PBMs from siphoning money out of the system and raising prices. @BrandiChane @MoniqueWhitney @Greg_Reybold @theangrypharm @HokiePharmacist

Greg Reybold: According to DOD's own data, it is cheaper for a military family to fill at a retail pharmacy than to fill at ESI's mail order, both to the beneficiary AND to the government. In 2018, a 30 day generic medication was cheaper at retail by ~85% than at mail order.

And Ohio lawmakers continually refuse to regulate these PBM/health insurer machinations...to the detriment of those with chronic and/or rare diseases
Copay maximizers: the accumulator's cousin. The PBM treats your member's copay card as the maximum benefit, drains the full year's value into its own pocket, and still counts none of it toward the deductible. Different name. Same hand, same pocket.

You gotta love it... The same week that the PBM lobby is trying to reform its image, it filed lawsuits against Illinois and Tennessee to stop price transparency and block PBM reform. Guess you could say PBM lawyers are #AlwaysOn healthcaredive.com/news/pcmaโ€ฆ
The PBM lobby is making the rounds in DC to discuss its seven-figure ad campaign to repair its reputation with lawmakers. The problem with PBMs isn't that we don't know who they are; it's that they've finally been exposed! PBMs have testified repeatedly before Congress. They've been sued by multiple attorneys general across the country, as well as by the Federal Trade Commission.
