OP-ED: Senate Republicans could enable recess appointments. They control both the House and Senate. The Constitution provides the mechanism. Yet they are holding pro forma sessions that block them. @jameswallner explains why: lyceumnow.com/why-the-senate…

This is correct. The holdup we're seeing on the SAVE America Act isn't limited to one party, and it isn't anything new. The Senate's big problem here isn't about policy or ideology. It's because too many people on both sides won’t put the time in to deliver for their constituents. This place needs to CHANGE IMMEDIATELY. legislativeprocedure.com/blo…

There won’t be a special election to elect someone for the remainder of the term in this case, because the general election for Graham’s seat is so close. Instead, as you said, there will be an appointment and that appointed will serve the remainder of the term.

“We don’t have 60 votes” is a lame excuse for not passing a bill. Especially one that’s popular with an overwhelming supermajority of voters—across party lines. My friend @jameswallner explains why in this excellent thread.
Republican leaders say they can’t pass the SAVE America Act because they don’t have 60 votes. That argument rests on a bad assumption: that the Senate cannot pass major legislation without first invoking cloture. That assumption is wrong. 🧵

When it comes to the filibuster, a lot of folks in the Senate are hiding behind “precedent” that isn’t really there. For the majority of its history, this chamber didn’t rely on a 60 vote threshold for legislation — even after the cloture rule was established. If we want to accomplish what the American people expect of us — like SECURING OUR ELECTIONS — we need to get back to that. Use it or lose it. Either enforce the filibuster or get rid of it. But we can’t continue like this.

The House doesn't run on votes so much as on rules about votes. With a majority of a seat or two, any lone member can seize that machinery and bring the floor to a halt. @jameswallner does the math behind the paralysis: lyceumnow.com/the-tiny-rule-…

Talking filibuster going well... No senator is seeking recognition, and the Senate is not in a quorum call, yet the chair is not putting the question on the pending amendment.

Because - while a good step to get on the bill - there is no intent to force a talking filibuster. The strategy appears to be to burn some time, amp up message, and pray Dems opt to cut a deal. It’s better than nothing but it’s not the full play… (as you know)
Both sides are demonstrating that they don’t know how to make a talking filibuster work. Democrats granted consent to waive the reading of multiple amendments right at the outset of the debate. And Republicans have held floor instead of requiring Democrats to hold floor and talk.
