意図的な海底ケーブル損害に関するEagle S号のヘルシンキ高裁判決についての記事。97条の「航行上の事故」の解釈や59条の位置付けについて同意。ただ、記事でも書かれていますが、他の事件でより問題となり得る執行管轄権については論じられず。事件的に不要なので当たり前ですが。#海洋法

International Straits Regime under UNCLOS – Transit Passage, Seafarer’s Protection and Global Maritime Order
Co-sponsored by: ASIL’s Law of the Sea Interest Group; Rashtriya Raksha University; and Singapore Management University
Under the UNCLOS, state parties need to protect the transit passage through straits used for international navigation. Recent operational experience affecting commercial maritime trade and navigation, safety and security of seafarer’s and crew movement, and access to timely assistance has sharpened the human dimension. Resolution A/HRC/Res/56/18 adopted 16 July 2024 by the Human Rights Council, clearly states that the shipping industry and all relevant stakeholders must protect the human rights of seafarers. The only solution is to return to peace, dialogue, multilateralism and diplomacy, and in particular, restore safety in this vital maritime corridor for seafarers and ships, as well as safeguarding the fundamental principle of freedom of navigation.
