DPP secures 20-year prison sentence for Tinderet man convicted of defiling 14-year-old girl with disability
The Director of Public Prosecutions (DPP) has secured a 20-year prison sentence for a man convicted of defiling a 14-year-old girl in Tinderet.
The convict was found guilty of defilement by Principal Magistrate Sylvia Ashitsa Muhanda, contrary to Section 8(1) as read with Section 8(3) of the Sexual Offences Act. He had also faced an alternative charge of committing an indecent act with a child, contrary to Section 11(1) of the same Act.
The conviction followed a full trial during which the prosecution, led by Prosecution Counsel Mr. Kaburu Perminus, called five witnesses and produced exhibits to prove its case beyond reasonable doubt.
The court heard that on 30th March 2025, the minor was running errands for her mother when the accused person allegedly dragged her into a milking pen, where he proceeded to defile her. When the minor took longer than expected to return home, her mother sent her sibling to look for her. The sibling later discovered that the minor had been seen with the accused person.
The minor eventually returned home and reported the incident to her mother, who subsequently reported the matter to the police. The accused person was arrested and arraigned in court, whereupon the trial commenced.
During the trial, it emerged that the minor was a child with a disability who had experienced psychological and developmental challenges since the age of nine months. This was relevant to the court's consideration of her circumstances and needs.
Principal Magistrate Muhanda found that the prosecution had proved the charge beyond reasonable doubt and subsequently sentenced the convict to 20 years' imprisonment. The convict has 14 days within which to appeal.

DPP secures life sentence for Bungoma man who defiled six-year-old girl.
The Director of Public Prosecutions (ODPP) has secured a life sentence against a man convicted of defiling a six-year-old girl in Bungoma County, following a successful prosecution supported by the victim’s testimony, medical evidence and corroborating witness accounts.
In a judgment delivered on 16th September 16 2026, Hon. W.J. Gichimu found that the prosecution had proved all the essential elements of the offence, including the age of the victim, penetration and the positive identification of the offender, beyond reasonable doubt.
The case was successfully prosecuted by Prosecution Counsel Wycliffe Minishi, who presented five witnesses, including the child’s mother, the investigating officer and a clinical officer who produced medical records confirming injuries consistent with defilement.
During the trial, the child narrated how the accused, who frequently visited their home because he was in a relationship with her grandmother, lured her to his house under the pretext of giving her vegetables.
When the child failed to return home, her grandmother became concerned and sent her brother to look for her. Upon reaching the accused’s house, he found the door locked. After knocking, the child opened the door while crying, with the accused inside the bedroom.
The child subsequently disclosed that the accused had “slept on top of her”, prompting her grandmother to take her to hospital, where a medical examination confirmed penetration.
In its determination, the court found the child’s testimony truthful, clear and consistent. It noted that her demeanour while testifying inspired confidence and that her evidence remained unshaken during cross-examination.
The court further held that the child's account was sufficiently corroborated by the medical evidence and testimonies of the other prosecution witnesses, establishing the accused’s guilt beyond reasonable doubt.
